(Kienthuc.net.vn) - Nhiều bạn trẻ là học sinh, sinh viên tại Đà Lạt (Lâm Đồng) vui Hội trăng rằm nhưng không quên trong mình hình ảnh biển đảo quê hương thiêng liêng nơi phía Đông tổ quốc.

Danlambao - Với chủ đề "Văn Chương, Truyền Thông và Nhân Quyền", Đại hội Thế giới kỳ thứ 78 của Văn Bút Quốc tế vừa diễn ra tại thành phố Gyeongju, Nam Hàn từ ngày 9 đến ngày 15 tháng 9 năm 2012. Hơn 80 Trung tâm Văn Bút Quốc Tế từ khắp năm châu đã gởi đại biểu tham dự. Số người hiện diện, gồm rất đông các tác giả đủ bộ môn văn học và nhiềungôn ngữ khác nhau, trong các buổi họp chuyên biệt và sinh hoạt văn học nghệ thuật của Đại hội ước lượng gần 700 người. Trong đó có hai nhà văn Nobel Văn chương Wole Soyinka và Jean-Marie Gustave Le Clézio.

Nhà thơ Nguyên Hoàng Bảo Việt, đại biểu của Trung tâm Văn Bút Thụy Sĩ Pháp thoại, đã gởi cho  chúng tôi bản dự thảo QUYẾT NGHỊ về VIỆT NAM. Bản Văn đã được Hội đồng Đại biểu của Văn Bút Quốc Tế đồng thanh thông qua, không một phiếu trắng, không một phiếu chống. Thi hữu đã đích thân trình bày lý do vì sao phải có Quyết Nghị về Việt Nam, lúc duyệt xét tại phiên họp của Ủy Ban Văn Bút Quốc Tế Bênh Vực Nhà Văn bị Cầm Tù và trước khi Hội đồng Đại biểu Văn Bút Quốc Tế biểu quyết chấp thuận trong phiên họp khoáng đại sáng ngày 14 tháng 9 năm 2012. Nhà thơ Nguyên Hoàng Bảo Việt đã đặc biệt cảm ơn hai nữ văn hữu Phó Chủ tịch Văn Bút Quốc Tế, Phó Chủ tịch Ủy ban Nhà Văn Nữ và nhiều văn hữu của các Trungtâm Văn Bút bạn đã mau chóng gởi lời chia buồn đến thân nhân của nhà báo viết Nhựt ký điện tử và nhà luật học Tạ Phong Tần đang bị cầm tù sau khi được báo tin về cái chết của thân mẫu của bà. Bản phúc trình đọc trước Đại hội Văn Bút Quốc Tế của Ủy ban Nhà Văn Nữ cũng đã lưu ý tất cả các đại biểu có mặt về cái cái chết của bà Đặng Thị Kim Liêng, một người Mẹ Việt Nam dũng cảm và bất khuất dưới chế độ độc tài CS áp bức và phi nhân nghĩa.

Trong một bản tin sau, chúng tôi hy vọng có thể đăng thêm tin tức về Đại hội Thế giới Văn Bút Quốc Tế ở Nam Hàn khi gặp lại nhà thơ Văn Bút Thụy Sĩ Pháp thoại. Nhà thơ có lưu ý chúng tôi rằng bản văn Quyết Nghị đã được cập nhựt tin tức cho tới ngày cuối tháng 8. Do đó, bản án tù 4 năm của nhà báo Hoàng Khương và tình trạng được trả lại tự do ‘có điều kiện’ (còn án tù quản chế) của hai nhà dân chủ đối kháng Nguyễn Văn TúcPhạm Văn Trội cũng như nhà báo độc lập, cô Phạm Thanh Nghiên, sẽ được phổ biến trong Bảng Danh Sách các nhà cầm bút bị đàn áp và ngược đãi trên thế giới (tài Liệu PEN International Writers in Prison Committee Case List July to December 2012). Cần nói thêm rằng nhà thơ tù nhân thế kỷ Nguyễn Hữu Cầu và nhạc sĩ kiêm ca sĩ tù nhân Việt Khang, tác giả các ca khúc Bà Má Miền Tây, Việt Nam Tôi Đâu và Anh là Ai? đã được Ủy Ban Văn Bút Quốc Tế Bênh Vực Nhà Văn bị Cầm Tù chính thức côngnhận như tất cả những người cầm bút bị đàn áp và cầm tù bất công vì sử dụng quyền tự do phát biểu và thể hiện quan điểm.

Quyết Nghị về Việt Nam do Trung tâm Văn Bút Thụy Sĩ Pháp thoại soạn thảo với sự tán trợ của các Trung tâm Văn Bút Thụy Sĩ Đức thoại, Văn Bút Thụy Sĩ Ý thoại và Réto-romanche

Nhận định rằng:

VIỆT NAM vẫn còn là một mối quan tâm lớn: Nhà cầm quyền tiếp tục đàn ápquyền tự do phát biểu và thể hiện quan điểm. Họ cho áp dụng các điều luật hình sự nhằm hủy diệt tự do. Phải kể đặc biệt là điều 88 ‘’Tuyên truyền chống nhà nước CHXHCHVN’’ và điều 258 ’’Lợi dụng các quyền tự do dân chủ, xâm phạm lợi ích của Nhà nước”. Bị cáo buộc bởi điều 88, người vô tội có thể bị kết án đến 20 năm tù giam; với điều 258, có thể bị tuyên phạt đến 7 năm tù giam. Các tòa báo in, các cơ quan truyền thông đại chúng (phát thanh và truyền hình), mạng lưới Internet và các cơ sở xuất bản bị nhà nước kiểm soát chặt chẽ và chịu sự kiểm duyệt gắt gao. Việc hạn chế tùy tiện trắng trợn vẫn còn hiệu lực đối với quyền tự do tìm kiếm, thu nhận và trao đổi tin tức, nhứt là các tin tức nhằm xác định trách nhiệm đối với các hành động vi phạm nhân quyền, tham nhũng và bất công xã hội. Nhiều nhà văn, nhà báo, tác giả nhựt ký điện tử và các nhà hoạt động bênh vực nhân quyền là nạn nhân của những hành vi sách nhiễu, những trận đánh đập tàn nhẫn, những vụ bắt giữ độc đoán, những sự đối xử võ phu, hung bạo của công an cùng những đòn tra tấn. Những người vô tội đó thường phải trải qua những tháng năm kéo dài thời gian giam cứu trước khi bị đưa ra xét xử tại những phiên tòa thiếu công minh để chỉ nhận lấy những bản án tù nặng nề bất nhân. Trong các trại lao động cưỡng bức, tù nhân ngôn luận và lương tâm nào từ chối nhận tội hoặc tuyệt thực để phản đối các điều kiện giam cầm vô nhân đạo đều bị biệt giam và/hoặc bị nhốt kín ở một nơi không ai biết. Tù nhân mắc bệnh nặng bị tước quyền được chăm sóc y tế thích hợp và được gặp gia đình tới thăm nom. Một số tù nhân đó đã bị tù thường phạm hành hung. Những tù nhân ngay sau khi rời trại giam đều phải bị quản thúc tại nhà trong khuôn khổ án tù quản chế đến 5 năm.

Bất bình và phẫn nộ vì được báo động về tình trạng sức khỏe tồi tệ và điềukiện giam cầm vô nhân đạo của nhiều nhà văn, nhà báo và tác giả nhựt ký điện tử bị hành hạ ngược đãi. Trong số những trường hợp nguy cấp nhứt (Bảng Danh sách không đầy đủ đính theo dưới đây) :

- Linh mục Nguyễn Văn Lý, biên tập viên của tạp chí Tự do Ngôn luận (không được CS công nhận hợp pháp). Năm 2007, Linh mục bị kết án 8 năm tù giam và 5 năm tù quản chế.Trước đây, Linh mục từng bị tù giam 15 năm trong khoảng thời gian 1977-2005. Tháng 11 năm 2009, Linh mục bị tai biến mạch não gây liệt nửa người phải. Lo sợ Linh mục Nguyễn Văn Lý sẽ chết nếu bị tai biến mạch não một lần nữa, bộ Công an đã chuyển Linh mục về thành phố Huế vào tháng 3 năm 2010. Linh mục bị quản thúc có công an kiểm soát trong lúc trị bệnh. Ngày 25 tháng 7 năm 2011, Linh mục đã bị công an đưa trở lại trại tù để thi hành tiếp bản án tù giam cho tới cuối vào năm 2015. Linh mục vẫn bị liệt một phần cơ thể và bị chứng u tuyến tiền liệt có thể chuyển thành ung thư.

- Ông Nguyễn Xuân Nghĩa, nhà văn và nhà thơ, nguyên hội viên Hội Nhà văn Hải phòng, thành viên Khối 8406 (Mạng lưới Bênh vực Nhân Quyền), đồng biên tập viên báo Tổ Quốc (không được CS công nhận hợp pháp), tác giả của nhiều bài thơ, truyện ngắn, bút ký, sổ tay, bài báo. Năm 2009, ông bị kết án 6 năm tù giam và 3 năm tù quản chế. Lên tiếng phản đối những điều kiện giam cầm tồi tệ và một mực xác quyết mình vô tội, ông bị biệt giam nhiều tháng trời trong năm 2011. Ông lại còn bị tước quyền được chăm sóc y tế thích hợp và được gặp gia đình tới thăm nom. Hiện ông đang bị chứng trĩ, loét dạ dày, sỏi thận và viêm khớp.

- Ông Nguyễn Văn Hải (bút hiệu Điếu Cày), nhà báo độc lập và tác giả nhựt ký điện tử, đáng lẽ ông phải được trả lại tự do sau khi đã mãn hạn án tù giam (2 năm 6 tháng) vào tháng 10 năm 2010. Tuy nhiên ông lại bị chuyển vào trại giam của bộ Công an thành phố HCM dường như với các cáo buộc vào điều 88 luật hình sự. Các cáo buộc đó được cho là căn cứ vào các bài viết trên Internet của ông trước khi ông bị bắt vào năm 2008 nhằm cổ xúy cho Câu Lạc Bộ Nhà báo Tự do ở Việt Nam. Một mực xác quyết mình vô tội, ông bị nhốt kín ở một nơi không ai biết. Ông bị tước quyền được gặp gia đình tới thăm nom. Ông không được quyền nhận thư từ, thuốc men và thực phẩm từ ngày 18 tháng 10 năm 2010 cho tới ngày 2 tháng 5 năm 2012. Sức khoẻ của ông vốn đã yếu kém lại càng suy giảm thêm sau khi ông tuyệt thực trong năm 2011.

Cực lực lên án những vi phạm quyền tự do phát biểu và thể hiện quan điểm tại Việt Nam và thúc giục nhà nước CHXHCNVN:

- Trả tự do, ngay lập tức và không điều kiện, Linh mục Nguyễn Văn Lý, nhà văn Nguyễn Xuân Nghiã, nhà báo Nguyễn Văn Hải và tất cả những nhà văn,nhà báo, tác giả nhựt ký điện tử bị hành hạ ngược đãi được nêu tên trong. Danh sách đính theo dưới đây, cũng như tất cả những người khác đang bịnhốt tù hoặc giam cứu chỉ vì đã hành sử quyền tự do phát biểu và thể hiện quan điểm của mình;

- Chấm dứt các tấn công, sách nhiễu, đe dọa bắt bớ hoặc giam cầm độc đoán đối với những người có quan điểm và chính kiến khác biệt hoặc nhữngngười cổ xúy cho tự do tư tưởng, tự do về lương tâm, tôn giáo và tín ngưỡng;

- Bãi bỏ mọi hạn chế tùy tiện đối với các cựu tù nhân ngôn luận và lương tâm, kể cả những người vẫn chưa hết hạn tù quản chế;
Cải
thiện điều kiện giam cầm trong - các nhà tù và các trại lao động cưỡng bức, chận đứng việc để các tù thường phạm gây hấn và tấn công các tù nhân ngôn luận và lương tâm, nghiêm cấm và trừng phạt mọi hình thức tra tấn, hành hạ ngược đãi, cho phép các tù nhân ngôn luận và lương tâm mắc bệnh được chữa trị tại bệnh viện, được chăm sóc y tế thích hợp, cũng như tạo điều kiện dễ dàng cho gia đình tới thăm nom; X
óa
bỏ mọi hình thức kiểm duyệt và - giải tỏa các cấm đoán về quyền tự do
phát biểu và thể hiện quan điểm, quyền tự do báo chí, quyền được thông
tin bằng mọi phương tiện kể cả nhứt là Internet, cũng như quyền tự do
hội họp và tự do lập hội, phù hợp với các Điều 19, 21 và 22 của Công ước Quốc tế và các quyền Dân sự và Chính trị (PIDCP/ICCPR).

Ông Lê Văn Sơn (Paulus) bị bắt hồi tháng 8 năm 2011, ông Nguyễn Văn Khương (bút hiệu Hoàng Khương) bị bắt hồi tháng giêng năm 2012, ông Phan Thanh Hải (bút hiệu Anh Ba Sài Gòn) bị bắt hồi tháng 10 năm 2010, bà Tạ Phong Tần (tác giả nhựt ký Công Lý và Sự Thật) bị bắt hồi tháng 9 năm 2011, ông Trần Vũ Anh Bình bị bắt hồi tháng 9 năm 2011, ông Võ Minh Trí (bút hiệu Việt Khang) bị bắt hồi tháng 12 năm 2011.

Résolution sur le Viet Nam soumise par le Centre PEN Suisse Romand et appuyée par le Centre PEN Suisse Allemand et le Centre PEN Suisse Italien et Réto-romanche

L'Assemblée des Délégués de PEN International, réunie à son 78e Congrès International à Geongju, en Corée, du 9 au 15 septembre 2012

Le VIET NAM reste une grande préoccupation: Il continue à réprimer le droit à la liberté d‘expression et d’opinion, en appliquant des articles liberticides de son Code pénal, en particulier l’Article 88 ‘’Propagande contre l’Etat’’ prévoyant des peines maximales de 20 ans de prison et l’Article 258 ‘’Abus des libertés démocratiques pour porter atteinte aux intérêts de l’Etat’’ prévoyant des peines maximales de sept ans de prison. La presse écrite, les médias audiovisuels, Internet etles maisons d'édition sont sous le strict contrôle de l'Etat et soumis à une censure sévère. Il y a d’un restriction flagrante à la liberté dechercher, de recevoir et de transmettre des informations, notamment celles relatives à la responsabilité des violations des droits de l’homme, à la corruption et à l'injustice sociale. Plusieurs écrivains, journalistes, blogueurs et défenseurs des droits de l’homme sont victimes de harcèlement, d’agression physique, d’arrestation arbitraire, de brutalité policière et de torture, de longue détention préventive,de procès inéquitable et de lourdes peines de prison. Dans les camps detravaux forcés, les prisonniers qui refusent de plaider coupable ou se livrent à une grève de la faim pour protester contre les conditions de détention inhumaines sont maintenus à l'isolement et/ou au secret. Les prisonniers gravement malades se voient refuser leur droit de recevoir un traitement médical adéquat et de visites de famille. Certains ont été attaqués par les détenus de droit commun. Les prisonniers libérés sont placés en résidence surveillée dans le cadre de la détention probatoire jusqu’à 5 ans.

Choquée et indignée par l'état de santé alarmant et les conditions de détention inhumaines des cas les plus urgents des écrivains, journalistes et blogueurs persécutés, entre autres (Liste non exhaustive en Annexe)

. Nguyen Van Ly, prêtre et rédacteur de la revue clandestine Tu Do Ngon Luan (Liberté d’Opinion). Il a été condamné en 2007 à 8 ans de prison et 5 ans dedétention probatoire. Il avait déjà purgé 15 ans de prison entre 1977 et 2055. En novembre 2009, une hémorragie méningée l’a paralysé du côté droit. Craignant qu’il ne succombe à une autre hémorragie méningée, la Sécurité Publique l’a transféré à la ville de Hue en mars 2010. Il a été placé pour 12 mois sous contrôle de la police, afin de recevoir des oins avant de retourner au camp; Le 25 juillet 2011, une ambulance de la police l’a ramené au camp pour purger le reste de sa peine jusqu’en 2015. Il souffre encore d’une paralysie partielle et d’une inflammation de la prostate qui pourrait être un cancer.

. Nguyen Xuan Nghia, poète et romancier, membre de l’Association des Ecrivains à Hai Phong et du réseau interdit des défenseurs des droits de l’Homme (Bloc 8406),corédacteur de la revue clandestine To Quoc (Patrie), auteur de plusieurs poèmes, nouvelles, notes, mémoires et articles. Il a été condamné en 2009 à 6 ans de prison et 3 ans de détention probatoire.Elevant sa voix contre les mauvais traitements et plaidant non coupable, il a été maintenu à l’isolement pendant plusieurs mois en 2011. Il a été privé de son droit de recevoir un traitement médical adéquat et des visites de famille. Il souffre d’hémorroïdes, d’ulcères à l’estomac, de calculs rénaux et de rhumatismes;

. Nguyen Van Hai (blogueur nom : Dieu Cay), journaliste indépendant et blogueur, qui aurait dû être libéré le 20 octobre 2010 après avoir purgé sa peine de deux ans et demi de prison, peine sous le prétexte fallacieux d’évasion fiscale en septembre 2008. Toutefois, le 18 octobre 2010, il avait été discrètement transféré dans un camp de détention de sécurité publique de la ville de Ho Chi Minh, apparemment sur des accusations en vertu de l’Article 88 du code pénal. Les accusations reposeraient sur ses écrits en ligne pour le Club des Journalistes Libres du Viet Nam, publiés avant son arrestation en 2008. Plaidant non coupable, il a été maintenu au secret, et privé de tout contact avec sa famille, et il n’a pas le droit de recevoir des lettres, des médicaments ou des vivres depuis le 18 octobre 2010 jusqu’au 2 mai 2012. Sa santé très fragile a été détériorée après avoir entamé une grève de la faim en 2011.

Condamne fermement les graves violations du droit à la liberté d'expression et d'opinion au Viet Nam et exhorte instamment la République Socialiste du Viet Nam à:

. Relâcher, immédiatement et sans conditions, Nguyen Van Ly, Nguyen Xuan Nghia, Nguyen Van Hai et tous les écrivains, journalistes et blogueurs persécutés figurant dans l’Annexe, ainsi que d’autres personnes en prison ou en détention préventive pour avoir exercé leur droit à la liberté d’expression et d’opinion;

. Arrêter toutes les attaques, les harcèlements, les menaces d’arrestations arbitraires ou de mise en détention préventive à l’encontre de tous ceux qui professent des vues dissidentes ou qui demandent la liberté de pensée, de conscience et de religion;
.
Lever toutes les restrictions arbitraires imposées sur d’anciens écrivains en prison, y compris ceux qui n’ont pas encore fini de purger leur détention probatoire;

. Améliorer les conditions dans les prisons et les camps de travaux forcés, stopper les actes d’agression perpétrés par des détenus de droit commun, interdire et punir toute forme de torture et de mauvais traitement, autoriser les prisonniers d’opinion qui sont malades à êtrehospitalisés et à recevoir des soins médicaux adéquats et faciliter les visites de leur famille;

Abolir toute censure et toute restriction sur la liberté d'expression et d’opinion, et de la presse, le droit à être informé par n'importe quel moyen, notamment l'Internet, ainsi que la liberté de réunion et d’association, conformément aux Articles 19, 21 et 22 du Pacte International sur les Droits Civils et Politiques.

The Assembly of Delegates of PEN International, meeting at its 78th World Congress in Geongju, Korea, 9th to 15th September 2012

VIETNAM: Vietnam remains of great concern: It continues to suppress the right to freedom of expression and opinion, through application of liberticidal articles of its Penal Code, in particular, Article 88 ‘’Propaganda against the State’’ providing sentences of up to 20 years in prison and Article 258 ‘‘Abusing democratic freedoms to infringe upon the State interests’’, up to 7 years in prison. Print and audiovisual media, Internet and publishing houses are under strict State control and subject to severe censorship. There is flagrant restriction on freedom to seek, receive and impart information, in particular relating to accountability for human rights violations, corruption and social injustice. Several writers, journalists, bloggers and human rights defenders have been victims of harassment, physical aggression,arbitrary arrest, police brutality and torture, lengthy pre-trial detention, unfair trial and heavy prison sentences. In forced labour camps, prisoners refusing to plead guilty or engaging in hunger strike to protest inhuman detention conditions are held in solitary confinement and/or incommunicado. Gravely sick prisoners are denied their right to receive adequate medical treatment and family visits. Some have been attacked by common law detainees. Released prisoners are placed under house arrest as part of the probationary detention for up to 5 years.

Shocked and indignant by the alarming state of health and inhuman detention conditions of the most urgent cases of persecuted writers, journalists and bloggers, among others (non-exhaustive list in Annex):

. Nguyen Van Ly, priest and editor of the underground review Tu Do Ngon Luan (Freedom of Opinion). He was sentenced in 2007 to 8 years in prison and 5 years in probationary detention. He previously served 15 years in prison between1977 and 2005. In November 2009, a stroke paralyzed the right side of his body. Fearing that he would die of other strokes, the Public Security transferred him to Hue city in March 2010. He was placed under police surveillance for 12 months in order to seek medical reatment before his return to the camp. On 25 July 2011, a police ambulance brought him back to the camp to serve the rest of his prison sentence until 2015. He still suffers from partial paralysis and an inflamed prostate that may be cancerous;

. Nguyen Xuan Nghia, poet and novelist, member of the Hai Phong Association of writers and the banned human rights defenders network (Bloc 8406), co-editor of the underground review To Quoc (Fatherland), author of several poems, short stories, notes, memoirs and articles. He was sentenced in 2009 to 6 years in prison and 3 years in probationary detention. Raising his voice against ill-treatment and pleading not guilty, he was held in solitary confinement during many months in 2011. He was denied his right to receive adequate medical treatment and family visits. He is suffering from haemorrhoids, stomach ulcers, gallstones and rheumatic inflammations;

. Nguyen Van Hai (pen name Dieu Cay), independent journalist and blogger, who should have been released on 20 October 2010 after completing his two-and-a-half year prison term, sentence on trumped-up charges of ‘’tax evasion’’ in September 2008. However, on 18 October 2010, he was discreetly transferred to a Public Security detention camp in Ho Chi Minh City, on charges under Article 88 of the Criminal Code. The charges a
re said to be based on his online writings for the banned Free Journalist Club in Viet Nam, published prior to his arrest in 2008. Pleading not guilty, he has been held incommunicado, without access to family visits, letters or medical and food supplies since 18 October 2010 until 2 May 2012. His fragile health has eteriorated, after he
engaged in a hunger strike in 2011.
Firmly condemns grave violations of the right to freedom of expression and opinion in Vietnam.

PEN International therefore calls the Socialist Republic of Vietnam to :
.
Release, immediately and unconditionally, Nguyen Van Ly, Nguyen Xuan Nghia, Nguyen Van Hai and all persecuted writers, journalists and bloggers currently in prison or in pre-trial detention for having exercised their right to freedom of expression and opinion.
. Cease all attacks, harassment, threat of arbitrary arrest or reventive detention against all persons who hold dissenting views or who call for freedom of thought, conscience, religion and belief.
.
Lift all arbitrary restrictions imposed on former imprisoned writers,including those who have not yet served their entire probationary detention terms.

. Improve conditions in prisons and in forced labour camps, stop acts of aggression perpetrated by common law detainees, ban and punish all forms of torture and ill-treatment, allow sick prisoners of opinion to be hospitalized and receive adequate medical care as well as facilitate their family visits.

. Abolish all censorship and restrictions on freedom of expression and opinion, freedom of the press, the right to be informed by all means including the Internet, and freedom of assembly and association, in compliance with the Articles 19, 21 and 22 of the International Covenant on Civil and Political Rights.

VIETNAM: Vietnam sigue siendo una gran preocupación: Continúa suprimiendo el derecho a libertad de expresión y opinión, por medio de la aplicación de artículos liberticidas de su Código Penal, en particular, el Artículo 88, "Propaganda contra el Estado", que provee sentencias de esta 20 años de prisión y el Artículo 258 "Abuso de libertades democráticas para infringir sobre los intereses del Estado”, hasta más de 7 años de prisión. Los medios impresos y audiovisuales, Internet y las editoriales están bajo un control estricto y sujetos a una censura severa. Hay una restricción flagrante sobre libertad para buscar, recibir e impartir información, en especial relacionada con responsabilidad de violaciones de derechos humanos, corrupción e injusticia social. Varios escritores, periodistas, bloggers y defensores de derechos humanos han sido víctimas de hostigamiento, agresión física, detención arbitraria, crueldad y tortura de la policía, prolongada prisión preventiva, proceso judicial injusto y fuerte condenas a prisión. En campos de trabajos forzados, los detenidos que se niegan a declararse culpables o participar en manifestaciones por hambruna para manifestar las condiciones de detención inhumanas se mantienen en celdas de aislamiento y/o incomunicados. A los prisioneros gravemente enfermos se les niega su derecho a recibir tratamiento médico adecuado y visitas familiares. Algunos han sido agredidos por prisioneros de derecho consuetudinario. A los detenidos liberados se los pone bajo arresto domiciliario como parte de la detención del período de prueba hasta 5 años.
Conmocionado
e indignado por el alarmante estado de salud y las condiciones de
detención inhumanas de la mayoría de casos urgentes de escritores,
periodistas y bloggers perseguidos, entre otros (lista no-exhaustiva en
Anexo):

· Nguyen Van Ly, sacerdote y editor de la revisión clandestina Tu Do Ngon Luan (Libertad de opinión). Fue condenado en 2007 a 8 años en prisión y 5 años en período de prueba. Previamente estuvo 15 años en prisión, entre 1977 y 2005. En noviembre 2009, un ACV paralizó el lado derecho de su cuerpo. Por temor a que tuviese otros ACVs, la Seguridad Pública lo transfirió a la ciudad de Hue en marzo 2010. Estuvo bajo vigilancia policial por 12 meses para buscar tratamiento médico antes de su regreso al campo. El 25 de julio 2011, una ambulancia policial lo llevó nuevamente al campo para cumplir con el resto de se condena hasta 2015. Aún sufre de parálisis parcial y una próstata inflamada que podría ser cancerígena.

· Nguyen Xuan Nghia, poeta y novelista, miembro de la Asociación de Escritores Hai Phong y la red de defensores de derechos humanos censurada (Bloque 8406), coeditor de la revisión clandestina To Quoc (Fatherland), autor de varios poemas, cuentos cortos, notas, memorias y artículos. Fue condenado en 2009 a 6 años en prisión y 3 años en período de prueba. Al levantar su voz contra el maltrato y no declararse culpable, se lo mantuvo en una celda de aislamiento durante muchos meses en 2011. Se le negó su derecho a recibir tratamiento médico adecuado y visitas familiares. Sufre de hemorroides, úlceras estomacales, cálculos biliares e inflamaciones reumáticas.

· Nguyen Van Hai (seudónimo Dieu Cay), periodista independiente y blogger, que ha sido detenido el 20 de octubre 2010 después de completar su prisión de dos años y medio, sentencia por cargos falsos por "evasión impositiva" en septiembre 2008. Sin embargo, el 18 de octubre 2010, fue discretamente transferido a un campo de detención de Seguridad Pública en la Ciudad de Ho Chi Minh, por cargos bajo el Artículo 88 del Código Penal. Se comenta que los cargos están basados en sus obras escritas en línea para el Club de Periodistas Libres en Vietnam censurado, publicadas antes de su detención en 2008. Al no declararse culpable, se lo mantuvo incomunicado, sin acceso a visitas familiares, cartas o insumos médicos y comida desde el 18 de octubre 2010 hasta el 2 de mayo 2012. Su frágil salud se ha deteriorado, después de participar en una huelga por hambruna en 2011.

Firmemente condena graves violaciones del derecho a la libertad de expresión y opinión en Vietnam.
Por lo tanto PEN International insta a la República Socialista de Vietnam a:

Liberar, de inmediato e incondicionalmente a Nguyen Van Ly, Nguyen Xuan
Nghia, Nguyen Van Hai y a todos los escritores, periodistas y bloggers
procesados actualmente detenidos o en detención preventiva por haber
ejercitado su derecho a la libre expresión y opinión.

· Cesar todas las agresiones, hostigamiento, amenaza de detención arbitraria o preventiva contra todas las personas que tengan opiniones discrepantes o que pidan libertad de pensamiento, conciencia, religión ocreencia.

· Levantar todas las restricciones arbitrarias impuestas a ex escritores detenidos, incluso aquellos que todavía no hayan cumplido con la totalidad de su periodo de prueba.
·
Mejorar las condiciones en cárceles y campos de trabajos forzados, detener actos de agresión perpetrados por detenidos de derecho consuetudinario, prohibir y sancionar a toda forma de tortura y maltrato, permitir a los prisioneros de opinión ser hospitalizados y recibir atención médica adecuada así como también facilitar sus visitas familiares.

· Abolir toda censura y restricciones de libertad de expresión y opinión, libertad de prensa, el derecho a estar informado por todos los medios incluso Internet y libertad de reunión y asociación, en cumplimiento con los Artículos 19, 21 y 22 del Pacto International de Derechos Civiles y Políticos.
